2023 Calendar Contest Rules

Official Contest Rules

1. Sponsor. The Calendar Contest (Contest) is sponsored by EcoPoxy Inc., P.O. Box 220, Morris, Manitoba Canada R0G 1K0 (Sponsor).
2. Eligibility.  This Contest is open to legal residents of Canada, excluding Quebec, who have reached the age of majority in their province or territory of residence at the time of entry, with the exception of employees of EcoPoxy, its parent, related and affiliated companies, subsidiaries, departments or agencies, franchisees, suppliers, advertising and promotional agencies, contest administrators, and any other parties engaged in the development, production, or distribution of Contest materials, and those living in the same household.  By participating in this Contest, entrants acknowledge compliance with, and agree to be bound by, these Contest Rules.  Entrants who do not comply with any of the Contest Rules are subject to disqualification by EcoPoxy, in EcoPoxy’s sole discretion.
3. Contest Dates and Times.  The Contest begins on September 26, 2022, at 12:00 p.m. CST and ends on October 12, 2022, at 12:00 p.m. CST (Contest End Date), after which time the Contest will be closed and no further entries will be accepted.
4. How to Enter.  You can enter by filling out the form on the EcoPoxy website (https://www.ecopoxy.com/2023-calendar-contest). For this Contest receipt of an Internet entry occurs when EcoPoxy's server records the entry information.  Hereinafter referred to as Contest Entry(ies).  All Contest Entries must be complete and are subject to verification by EcoPoxy, in its sole discretion. There is no limit to the number of entries which may be submitted.  Any attempt or suspected attempt to use robotic, automatic, programmed or otherwise illicit means to enter the Contest, or any other methods not authorized by these Contest Rules, shall be deemed as tampering and may disqualify you from entering, participating and/or winning a prize.  Contest Entries that contain false or incomplete information are void.  Contest Entries that are late, lost, stolen, illegible, contain false information, are damaged, misdirected, mutilated, garbled or incomplete, altered or otherwise irregular or that do not conform with or satisfy any or all of the conditions of the Contest Rules are void.  Entrants grant EcoPoxy a non-exclusive license to use all Contest Entries for any purpose.  No correspondence will be entered into except with Selected Entrants.  Proof of transmission (for example, screenshots or captures) does not constitute proof of entry or receipt of an entry.
5. Contest Prizes.  Twenty (20) entrants will receive a feature in EcoPoxy’s calendar for the year 2023 four (4) of which will be selected to win EcoPoxy products for receiving first, second and third place and winning the vote for People’s Choice.  Prizes available to be won are as follows:

First Place:

• 30 L FlowCast Kit,
• EcoPoxy spreader,
• EcoPoxy apron,
• 2 rolls of EcoPoxy tape,
• the cover feature in EcoPoxy’s calendar for the year 2023 and
• a certificate of achievement.

Approximate prize value $800.00

Second Place:

• 8 L UVPoxy Kit,
• 8 piece colour pigment set each a 60 mL volume,
• 1 set of 15x15 g metallic colour pigment
• 1 set of 12x15 g polyester glitter  
• EcoPoxy spreader,
• EcoPoxy apron,
• 1 rolls of EcoPoxy tape,
• a feature in EcoPoxy’s calendar for the year 2023 and
• a certificate of achievement.

Third Place:

People’s Choice:

• 6 L kit of EcoPoxy newest resin to be released by end of 2022,
• EcoPoxy spreader,
• EcoPoxy apron,
• 2 rolls of EcoPoxy tape,
• a feature in EcoPoxy’s calendar for the year 2023 and
• a certificate of achievement.

Additional Calendar Features:

• An additional 16 contest entries are guaranteed to be featured in EcoPoxy’s 2023 calendar.

All winners assume any and all liability for any injury or damage caused, or claimed to be caused, by entering, participating in this Contest or the use or redemption of a prize.  Prizes must be accepted as awarded and have no cash value. Prizes or any portion of a prize cannot be combined with other discounts, promotions, or special offers. EcoPoxy reserves the right to substitute an alternate prize of equal or greater value if an advertised prize unavailable at the time of award.

1. Odds of Winning.  For all prizes the odds of winning depend on the number of eligible Contest Entries received before the Contest End Date. The odds of winning the People’s Choice prize depend on the number of eligible Contest Entries before the Contest End Date and the number of votes they received on EcoPoxy’s Instagram page. 
2. Skill-testing Question.  Selected Entrants will be required, as a condition of winning a prize, to correctly answer, without assistance of any kind, EcoPoxy’s time-limited, mathematical skill-testing question which will be provided to entrants selected as winners of the contest with the Winner Release Forms.
3. Winner Selection and Confirmation. On October 13, 2022 at beginning at 12:00 p.m. CST at EcoPoxy Inc. P.O. Box 220, Morris, Manitoba, Canada R0G 1K0, four (4) judges will choose five (5) entries each basing their choice on technical and artistic skill. Those selected will represent the top twenty (20) entries in the contest and will be featured in EcoPoxy’s calendar for the year 2023. These twenty (20) entries will continue to the next stage of selection where the judges will award first, second, and third place prizes based on the entrants artistic and technical skill.

Between October 13, 2022, at 12:00 p.m. CST and October 15, 2022 at 12:00 p.m. CST the top twenty (20) selected entrants will be notified that they will be featured in EcoPoxy’s 2023 calendar and will receive EcoPoxy’s Winner Release Form a signed copy of which must be returned no later than October 21, 2022.    The top three (3) entries will be notified of the prize they have won and the remaining seventeen (17) will be notified that their entry will be posted on EcoPoxy’s Instagram page to be judged by their peers for the People’s Choice prize.  Up to three attempts to contact the top twenty (20) selected entrants will take place. 

The People’s Choice prize will be awarded to the entry that receives the most votes on Instagram in a 24-hour period beginning on October 15, 2022 at 12:00 p.m. CST and ending on October 16, 2022, at 12:00 p.m. CST.

Entrants will be deemed winners if they meet all of the eligibility criteria set out in these Contest Rules.  If a Selected Entrant does not meet the eligibility criteria, he/she will be disqualified and will not receive a prize and another entrant will be selected from the remaining eligible Contest Entries by the same judging panel on the same basis of technical or creative skill.

A selected entrant that does not or cannot accept a prize may be forfeited and a new entrant will be selected by the panel of judges based on technical and artistic skill , in EcoPoxy’s sole discretion.  EcoPoxy is not responsible for the failure for any reason whatsoever of a selected entrant to receive notification or for EcoPoxy to receive a selected entrant’s response.

Disputes regarding identity of entrant: If the identity of a selected entrant is disputed, the entry will be deemed to have been submitted by the individual assigned to the email address submitted at the time of entry. Each selected entrant may be required to provide proof that he/she was of legal age in his/her province at the time of Entry.

2. Other Conditions.  EcoPoxy reserves the right to terminate or amend this Contest at any time and in anyway, without prior notice to entrants.  Without limiting the foregoing, f, for any reason, the Contest is not capable of running as originally planned for any reason, EcoPoxy reserves the right to cancel the Contest and conduct a random draw from all previously received eligible Contest Entries received by the Contest End Date.
3. Content Consent and Release  The term “Content” applies to the contest entry that the entrant provides to EcoPoxy, including but not limited to:

• Any images, photographs, and pictures, together with any modifications, reproductions, and depictions of same, and together with any and all intellectual property rights relating thereto.

Entrant consents and grants to EcoPoxy the irrevocable right and unrestricted permission, in perpetuity, worldwide:

a.       To edit, combine and modify the Content at its discretion; and

b.       To publish, make, distribute, show, record, reproduce, use, broadcast, translate into other languages, formats and/or mediums and exploit the Content in any manner, form, format, or media whatsoever now or hereafter or later known, for the purpose of trade, advertising, describing, publicizing or promoting EcoPoxy and its activities, products and services (the “Purpose”).

Entrant represents and warrants

a.       that the Entrant owns or otherwise controls all of the rights, including moral rights and intellectual property rights, to the Content.

b.       that the Entrant can grant or has obtained all rights and consents that are necessary for them to grant any rights and licences described herein and relating to the Content to EcoPoxy.

c.       that the Content is accurate and is original to the Entrant and that no other party has any rights thereto.

d.       that the Content will not infringe the rights of any third party and will not otherwise cause injury to any person or entity.

e.       that the Entrant will immediately notify EcoPoxy of any Content that does not comply with the contents herein or may infringe the rights of a third party or third parties, and

f.        Entrant has consent of third parties to use their likeness if applicable to the Content.

Entrant understands that:

a.       The Content may appear on EcoPoxy’s website and social media accounts and that the Internet is not a secure medium,

b.       Any material posted on the Internet is accessible to and may be copied or altered by anyone with a computer,

c.       EcoPoxy cannot absolutely guarantee privacy or control the access to its website and social media accounts, and

d.       An inherent risk may include but is not limited to identity theft or danger to the Entrant.

Entrant waives:

a.       Any right to inspect or approve the Content or the uses of the Content, and any advertising copy or printed matter that may be used,

b.       All moral rights in the Content, and

c.       Any right to royalties or other compensation arising from or related to the Content or the use of the Content by EcoPoxy.

Entrant agrees and acknowledges that all right, title, and interest in the Content shall be the sole exclusive property of EcoPoxy free and clear of all claims of any kind whatsoever by the Entrant.  The Entrant assigns and transfers to EcoPoxy his/her entire right, title, and interest, if any, worldwide, in and to the Content, without any remuneration. 

Entrant releases and forever discharges EcoPoxy from and against any and all demands, causes of action, liability and claims, at law or in equity, of any nature or kind, including, without limitation, any action for copyright infringement, rights of publicity, misappropriation of personality, breach of privacy, invasion of privacy, defamation, libel or slander, that the Entrant or his/her heirs, executors, administrators, personal representatives, successors or assigns can, has ever had, now or may hereafter have arising out of or connected in any way with the Content.

Entrant acknowledges that EcoPoxy will rely on this Content Consent & Release potentially at substantial cost to the EcoPoxy, and the Entrant agrees not to assert any claim of any nature whatsoever against anyone relating to the exercise of the provisions of this Content Consent & Release.

1. Privacy and Personal Information.  By participating in the Contest, entrants consent to the use of their name, address, email address, postal code, telephone number, social media handle(s), comments, and image, whether a photograph, or any other means, for the administration of the Contest or any publicity carried out by EcoPoxy, without further notice or compensation. 

Collection, Use, Storage, and Destruction: EcoPoxy will collect the name, phone number, email address and home address at the time the contest is entered for the purpose of contacting contest winners, recognizing their work on EcoPoxys website and social media platforms including Instagram after the winners have been chosen, and for distributing prizes to the winners.  EcoPoxy takes measures to ensure that personal information is stored safely including limiting access to personal information to those employees who have the need to access the information as well as the use of technological safeguards including the use of firewalls.  EcoPoxy will only keep your personal information for as long as it is needed to execute this contest after which it will be permanently deleted.    

Third Parties: EcoPoxy has agreements in place with third parties which protect the personal information you provide and limit the use of personal information to the purposes specified to of fulfill the contract.

Your Rights:  Entrants may withdraw their consent at anytime by contacting EcoPoxy’s legal department however if an entrant withdraws consent EcoPoxy will have no way to contact that entrants or distribute prizes to that entrant.

You may also challenge EcoPoxy’s compliance with fair information principals by contacting the Office of the Privacy Commissioner of Canada via telephone at 1-819-994-5444, toll-free: 1-800-282-1376, via regular letter mail to The Office of the Privacy Commissioner of Canada 30 Victoria Street, Gatineau, Quebec, K1A 1H3, or visiting their website at https://www.priv.gc.ca/.  EcoPoxy also has internal processes for addressing challenges with compliance and requests that any concerns of this nature be forwarded to the legal department.

1. Law.  The Contest is void where prohibited by law and shall be governed exclusively by the laws of the province of Manitoba, and the laws of Canada including all issues and questions concerning the construction, validity, interpretation, and enforceability of these Contest rules, rights and obligations between entrants and EcoPoxy, and procedural provisions, without giving effect to any choice of law or conflict of law rules. Any dispute shall be adjudicated by the courts sitting in Winnipeg, Manitoba.
2. Rule Amendments.  EcoPoxy reserves the right, in its sole discretion, to amend or modify these Contest Rules, or modify, cancel, or suspend this Contest, without prior notice for any reason whatsoever, including without limitation in the event that any cause beyond the reasonable control of EcoPoxy corrupts, or threatens to corrupt, the security or proper administration of the Contest.
3. Intellectual Property.  All intellectual property, including but not limited to trademarks, logos, designs, promotional materials, web pages, source codes, images, drawings, illustrations, slogans, and representations are owned by EcoPoxy.  All rights reserved.  Unauthorized copying or use of any of EcoPoxy’s intellectual property without EcoPoxy’s express written consent is strictly prohibited.
